FedEx Sues U.S. Government for Full Refund of Trump-Era IEEPA Tariffs After Supreme Court Ruling

Feb. 23, 2026 — New York — FedEx Corp. filed a lawsuit in the U.S. Court of International Trade seeking a full refund, plus interest, of all tariffs it paid under President Trump’s emergency duties imposed via the International Emergency Economic Powers Act (IEEPA). The action follows a 6-3 Supreme Court ruling last Friday deeming the tariffs unlawful as exceeding presidential authority.

The complaint demands refunds from U.S. Customs and Border Protection for IEEPA duties FedEx paid as an importer of record, along with compensation for related financial harms such as expedited customs costs. FedEx previously anticipated a roughly $1 billion hit to fiscal-year earnings from U.S. trade policies, though the specific refund amount was not disclosed.

“Plaintiffs seek for themselves a full refund from Defendants of all IEEPA duties Plaintiffs have paid to the United States,” the lawsuit states.

“FedEx has taken necessary action to protect the company’s rights as an importer of record to seek duty refunds from U.S. Customs and Border Protection following the U.S. Supreme Court’s ruling that the tariffs issued under the International Emergency Economic Powers Act (IEEPA) are unlawful,” a company spokesperson said.

The tariffs, imposed starting February 2025 on imports from China, Canada, Mexico and later expanded to 57 countries citing national security and trade issues, generated over $175 billion in U.S. collections now potentially eligible for refunds. U.S. Customs and Border Protection ceased collecting IEEPA duties on Tuesday. Neither the agency nor the White House immediately responded to comment requests.

The Supreme Court’s decision in Learning Resources, Inc. v. Trump affirmed the Court of International Trade’s exclusive jurisdiction over such challenges. Observers anticipate a wave of similar suits from other firms, including Costco and Revlon, represented by the same law firm, Crowell & Moring.
